Policymakers should take action tohold these platforms accountable and protect American consumers and businesses. Ofthose, ITIF assessed that 24 were likely counterfeits, including cosmetics, toys, luxurygoods, pharmaceuticals, and household items. U.S. Customs and Border Protection correctly inspected a small fraction of probablecounterfeit shipments but ultimately failed to seize them, and neither inspected norseized any of the other probable counterfeit shipments, revealing gaps in enforcement. Temu and AliExpress, in particular, consistently failed to identify and delist probablecounterfeits, allowing them to remain available and accumulate significant sales. Addressing counterfeiting requires policy interventions that target both platforms andvendors, focusing on structural deterrents and enforcement gaps. The U.S. Trade Representative should designate Temu, AliExpress, and SHEIN asnotorious markets, and Customs and Border Protection should increase its AI-driven anti-counterfeiting capabilities to weight its enforcement toward these platforms.
