Instead of ensuring the swift and efficient use of these funds,the Biden Administration imposed significant non-statutory burdens and red tape that increasedtaxpayer costs, limited marketplace competition, and diverted resources away from actualdeployment. As a result of these counterproductive Biden Administration burdens, the BEADProgram has failed to put a single shovel in the ground since IIJA’s passage in 2021 —leavingmany Americans unconnected. This Policy Notice rights these wrongs and institutes muchneeded reforms to the BEAD Program that will realign the Program with statutory intent, speedbroadband deployment, and guarantee that American taxpayers receive the greatest “Benefit ofthe Bargain” for their historic investment. These reforms are necessary. NTIA nevertheless recognizes that stakeholders have investedsignificant resources participating in the BEAD Program since IIJA passed in 2021. Accordingly,this Policy Notice carefully balances the work that has previously been done with necessarychanges to ensure the success of the BEAD Program. Specifically, NTIA does not requireEligible Entities to repeat the initial stages of the Program but removes the extralegal BidenAdministration burdens and promotes greater competition.
