MEMORANDUM TO: Executive Branch Departments and Agencies Assistant Secretary of Commerce for Communications and lnfonnation (Acting) SUBJECT:Review of Current Frequency Assignments and Quantification ofSpectrum Usage With this memorandum and the enclosed guidance, the National Telecommunicationsand lnfonnation Administration (NTIA), on behalfofthe Secretary ofCommerce (Secretary),provides guidance to the executive branch departments and agencies (collectively "agencies") forconducting reviews of current frequency assignments and quantification of their spectrum usage. President Trump's October 25, 2018, Presidential Memorandum on "Developing aSustainable Spectrum Strategy for America's Future" calls for the development of acomprehensive, long-term National Spectrum Strategy.1In addition, Section 2(a) ofthePresident's memorandum requires the agencies to initiate a review of their current frequencyassignments and quantification oftheir spectrum usage in accordance with guidance to beprovided by the Secretary ofCommerce.2The enclosed guidance addresses this requirement. As stated in the Presidential Memorandum, spectrum-dependent systems areindispensable to the perfonnance of many United States Government missions.3In addition, thePresident mentioned that "flexible, predictable spectrum access by the United States Governmentwill help ensure that Federal users can meet current and future mission requirements for a broadrange of both communications and non-communications-based systems."4The President'smemorandum expected federal agencies to "thoughtfully consider whether and how theirspectrum-dependent mission needs might be met more efficiently and effectively, includingthrough new technology and ingenuity."5 One ofNTIA's core statutory responsibilities is to promote the best possible and mostefficient use of electromagnetic spectrum resources across the Federal Government, subject to, and consistent with,the needs and missions ofFederal agencies.6Pursuant to Section 105(c)(2)of the NTIA Authorization Act, as amended, “executive agencies are authorized and directed tocooperate with the NTIA and to furnish it with such information, support, and assistance, notinconsistent with law, as it may require in the performance of its functions.”7 The enclosed guidanceestablishes a process foragenciestoreviewtheircurrent data andprovideadditionalinformation, support, and assistanceregarding their assignments and usage ofspectrum.Towards this end,and in furtherance of the objectives of the PresidentialMemorandum,NTIAis requiringthatagencies review frequency assignment data in an initial setof bands and provide additional, specifieddata fields in order to validate the accuracy of existingdata and furtherquantify spectrum use.Similar to previous quantitative assessment efforts,NTIAwill then use this information to develop spectrum use contoursfor these initial bandsandanyadditional bands,to estimatethe extent to which each system uses its assigned spectrum.8Moreover,agencieswillcontinue, concurrently, to review theirfrequency assignments accordingto thecurrentschedule in their assignment records for all bands.9 Theinformation providedwillbe subject to existing safeguards protecting classified,sensitive, and proprietary data.At the same time, akey element of the National SpectrumStrategywill betransparency of spectrum use and improved cooperation and collaborationbetween federal and non-federal spectrum stakeholders.Similarly,thePresidentialMemorandum provides that the“Secretarymay release publicly a summary of informationprovided by agencies,to the extentconsistent with applicable law.”Accordingly,NTIA willposton its website (www.ntia.gov)this memorandum, the enclosedguidancedocument,andother reporting and analysis as appropriate and consistent with security guidelines.
