COMMUNICATION FROM THE COMMISSION TO THE EUROPEANPARLIAMENT, THE EUROPEAN COUNCIL, THE COUNCIL, THE EUROPEAN A Simpler, Clearer and Better Enforced EU Rulebook The European Union stands at a pivotal moment.It is facingatensegeopoliticalenvironment,economic pressureand threats to security and democracy.At the same time, it is engaged in anurgent effort to tackle the structural barriers that are holding it back and toimprovetheconditions forsupportingahighly competitive, innovativeand sustainablesocial marketeconomy.As part of that effort, we need to ensure a simple, efficient, transparent andenforceable regulatory framework,firmly grounded in the rule of law, and supporting a fullyintegrated single market.A united Europe that plays to its strengths and maintains a competitive The Commission operates one of the most advancedbetterregulationsystems,asrecognisedbythe OECD1,combining evidence, impact analysis and broad stakeholder consultation.Inparallel, ithastakenambitiousstepsto strengthen thesinglemarket, citizens’ rights andfundamental freedomsandtoprotectthe rule of law.Despite this,citizens, businesses andpublicadministrationsoften facecomplex, denseor ambiguous legislationat EU or national Fragmented, late,or half-hearted implementation of EU law hampers the achievement of theEU’s policy objectives, weakens thesinglemarket and undermines the EU’s competitivenessand resilience. Long-lasting, significant breaches of EU lawcanalso undermine the rule oflaw, whichremainsunderstrainin the current globalcontext. Guaranteeing the rule of law is This Communication aims to modernise how EU laws are designed,implemented andenforced,whileensuringtheyareclear,agile,and fit for purpose, thereby supporting theachievement of One Europe, One Market2. By streamlining procedures,strengtheningtheevidence-base of our proposals,andby ensuring thestrictapplication ofproportionality,theEU cansupportthe attainment of itspolicyobjectives, boostingcompetitiveness,reinforcing New EU initiatives should be in line with better regulation principles, including with‘simplicitybydesign’.They should beaccompanied by high-quality impact assessmentsandcontribute to the Union’spolicy objectivesin the most efficient manner.The measures andprinciples set out in this Communication will be reflected in the better regulation guidelinesandtoolbox andbe implemented gradually,with careful prioritisationof its actions.In turn, TheCommissionsolicitedstakeholders’ views on better regulationthrougha call for evidence3.Some288 submissionswere receivedfrom 27 countries4.Overall,stakeholders seebetterregulation tools as essential to the quality of EU lawmaking.They call forthese tools to be 1.SIMPLICITY BY DESIGN To create a more cohesive and efficient single market,the Commissionwantstoensure thatnewlegislative proposals avoid regulatory complexity and fragmentation.Regulatorysimplicity and clarity are among the key concernsraised bystakeholdersin the call for A proposal is ‘simple by design’ when thoseaffected by itcaneasily understand: −what the goal is,−who must do what and when,−hownewrights and obligations interact with existing ones,−howcompliance is achieved,and−what happens if obligations are not met. Laws should be clearto ensurethat they can be smoothlyimplementedandappliedconsistentlyand predictably, including by publicauthorities andby the courts.The Commissionwill seekto applya ‘simplicity by design’principle to its forthcoming legal proposals and calls upon the ‘Simplicity by design’has several dimensions: Regulatorydiscipline Tocreate a more effective and efficient regulatory framework, it is essential that Europeis ableto prioritiseand focus on the mostsignificantchallenges and risks.Regulatorydisciplineis ameanstoensurethattheprinciples ofsubsidiarity and proportionalityare appliedconsistentlyin EU law.
