2023.10.19 Measures for the Administration of VoluntaryGreenhouse Gas Emission Reduction Trading (Trial) Chapter I General Provisions Article 1: TheseMeasuresare formulated with the aims ofachieving China’s endeavors to peak carbon dioxide emissions andachieve carbon neutrality, controlling and reducing greenhouse gas(GHG)emissions resulting from human activities,encouragingvoluntaryGHG emission reductions,and standardizing nationalvoluntary GHG emission reduction trading and its related activities.TheseMeasuresare formulated in accordance with the directives oftheParty Central Committee and the State Council regardingestablishing a national voluntary GHG emission reduction tradingmarket, and relevant laws and regulations. Article 2: TheseMeasuresapply to the activities related tonationalvoluntary GHG emission reduction trading and itssupervision and management. Article 3: National voluntary GHG emission reduction tradingis market-oriented, and its related activities adhere to the principles ofequity, justice, openness, integrity, and voluntariness. Article4:Juridical persons and other legally establishedorganizations within the territory of the People's Republic of Chinaare permitted to engage in voluntary GHG emission reduction-related activities in accordance with these Measures and are allowed to applythe registration of voluntary GHG emission reduction projects andemission reductions. Juridical persons, other legally established organizations, andnatural persons who adhere to appliable regulations are eligible toengage in voluntary GHG emission reduction trading in compliancewith the provisions set forth in theseMeasures. Article 5:The Ministry of Ecology and Environment is taskedwith establishing a national voluntary GHG emission reductiontrading market, and formulating administration requirements andtechnicalspecifications for national voluntary GHG emissionreduction trading. The Ministry of Ecology and Environment holdsthe responsibility of supervising, managing, and providing guidancefor activities related to national voluntary GHG emission reductiontrading. Provincial-level ecological and environmental authorities areresponsible for supervising and managing voluntary GHG emissionreductiontrading and related activities within their respectiveadministrative regions. Municipal-level ecological and environmental authorities at thedistrict level shall cooperate with the provincial-level ecological andenvironmental authorities in supervising and managing voluntaryGHG emission reduction trading and related activities within theiradministrative regions. Themarket supervision administration authority and theecological and environmental authorities shall, according to their respective responsibilities, supervise and manage the bodies engagedinthe approval of GHG emission reduction projects and theverificationof emission reductions(hereinafter referred to as“validation and verification bodies”) and the bodies validation andverification activities. Article6:The Ministry of Ecology and Environmentestablishesa standardized national voluntary GHG emissionreductionregistration institution(hereinafter referred to as“registration institution”) and a national voluntary GHG emissionreduction registration system (hereinafter referred to as “registrationsystem”). The registration institution is responsible for operating andmanaging the registration system, handling the application of theregistrationand cancelation of emission reduction projects andemission reduction projects through the system. The registrationinstitutionalso records information related to voluntary GHGemissionreduction projects and verified voluntary emissionsreduction registration, holdings, changes, and cancellations. Theinformation recorded in the registration system serves as the finalbasis for determining the attribution and status of verified voluntaryemission reductions. In accordance with relevant national regulations, the registrationinstitutionmay formulate specific operational rules for theregistrationof voluntary GHG emission reduction projects andemission reductions and report them to the Ministry of Ecology andEnvironment for documentation. Article7:The Ministry of Ecology and Environmentestablishesa standardized national voluntary GHG emissionreductiontrading institution(hereinafter referred to as“tradinginstitution”) and a national voluntary GHG emission reduction tradingsystem (hereinafter referred to as “trading system”). Thetrading institution is responsible for operating andmanaging the trading system, providing centralized and unifiedtradingand settlement services for verified voluntary emissionreductions. Thetrading institution shall,in accordance with relevantnational regulations, implement effective measures to maintain thehealthy development of the market, prevent excessive speculation,and guard against financial risks.
