COMMISSION IMPLEMENTING DECISION of 11.9.2025 on the financing and on the adoption of an Action Programme for the Turkish Cypriotcommunity for 2025 COMMISSION IMPLEMENTING DECISION of 11.9.2025 on the financing and on the adoption of an Action Programme for the Turkish Cypriotcommunity for 2025 THE EUROPEAN COMMISSION, Having regard tothe Treaty on the Functioning of the European Union, Having regard to Regulation (EU, Euratom) 2024/2509 of the European Parliament and of theCouncil of 23 September 2024 on the financial rules applicable to the general budget of theUnion1(‘the Financial Regulation’), and in particular Article 110(1) thereof, Having regard toCouncil Regulation (EC) No 389/2006 of 27 February 2006 establishing aninstrument of financial support for encouraging the economic development of the TurkishCypriot community2, and in particular Article3thereof, Whereas: (1)Following the accession of Cyprus, the application of the acquis is suspended pursuantto Article 1(1) of Protocol No 10 to the Act of Accession 20033in the areas of theRepublic of Cyprusin which the Government of the Republic of Cyprus does notexercise effective control (hereinafter referred to as ‘the areas’).(2)Pursuant to Article 3(1) of Protocol No 10, nothing in the Protocol precludes measureswith a view to promoting the economic development of the areas.(3)Regulation (EC) No 389/2006 lays down the rules and conditions for the granting ofassistance to facilitate the reunification of Cyprus by encouraging the economicdevelopment of the Turkish Cypriot community with particularemphasis on theeconomicintegration of the island,on improving contacts between the twocommunities and with the EU, and on preparation for the acquisin view of thewithdrawal of its suspension in accordance with Article 1 of Protocol No 10 to the Actof Accession.(4)To ensure the implementation of the Action Programme for the Turkish Cypriotcommunity for the year 2025it is necessary to adopt a financing decision.Article 110ofthe Financial Regulationlays downdetailed rules onfinancing decisions.(5)The envisaged assistanceshouldcomply with the conditions and procedures set out bythe restrictive measures adopted pursuant to Article 215 TFEU.(6)The objectivesoftheannualAction Programme for the Turkish Cypriot communityfor 2025are:(i)promotion of social and economic development;(ii)development andrestructuring of infrastructure;(iii)reconciliation, confidence-building measures,and support to civil society;(iv)bringing the Turkish Cypriot communitycloser to theUnion;(v)preparation of legal texts aligned with the EU acquis for the purpose ofthese being immediately applicable upon the entry into force of a comprehensivesettlement of the Cyprus problem,and(vi)preparation for implementation of theacquis in view of the withdrawal of its suspension in accordance with Article 1 ofProtocol No 10 to the Act of Accession;and support for needs aimed at facilitating thesettlement process. (7)In the implementation of actions financed underRegulation(EC) No 389/2006, therights of natural and legal persons, including the rights to possessions and property,shouldberespected.(8)All individual legal commitments for this Action Programmeshouldbe concluded nolater than three years following the date of budgetary commitmentas stipulated inArticle 5(1) of Regulation (EC) No 389/2006.(9)TheCommission should entrust budget-implementation tasks under indirectmanagement to the entititiesspecified in theAnnex to this Decision, subject to theconclusion of contribution agreements. The Commissionshould ensure a level ofprotection of the financial interests of the Union with regards to entities and personsentrusted with the implementation of Union funds by indirect management as providedfor in Article 157(3) ofthe Financial Regulation.To this end, such entities and personsare to be subject to an assessment of their systems and procedures in accordance withArticle157(4)of Regulation(EU,Euratom)2024/2059 and,if necessary,toappropriatesupervisory measures in accordance with Article 157(5)before acontribution agreement can be signed.(10)It is necessary to authorise the award of grants without a call for proposals and toprovide forthe conditions for awarding those grants in accordance with Article201andArticle198(f)of the Financial Regulation.(11)It is necessary to allow for the payment of interest due for late payment on the basis ofArticle 116(5) oftheFinancial Regulation.(12)To enableflexibility in the implementation of the programme, it is appropriate toallow changesto be made as long as they are not considered substantial for thepurposes of Article110(5) ofthe Financial Regulation.(13)Themeasures provided for by this Decision are in accordance with the opinion of theIPA III Committee referred to in Article 17(7) of Regulation (EU) 2021/1529 of theEuropean Parliament and of the Council4, HAS DECIDED AS FOLLOWS: Article 1Theactionprogramme Theannual financing decision,constituting the
