First,the Committee approved the referral for consideration of theInternational Labour Conference, amendments to the Code of the MaritimeLabour Convention, 2006, as submitted following the Special TripartiteCommittee’s fifth meeting in April.These amendments address significant areas such as repatriation, shore leave,medical care, and measures to prevent and respond to shipboard violence andharassment.TheEmployers’Group supported the procedural adoption of theamendments. At the same time, we reiterated the importance of ensuringlegal clarity and coherence—particularly in relation to new definitions andreferences to Convention No. 190. As many of these amendments will havedirect practical implications for national implementation, we encourageMember States to carry out careful legal and operational assessments indialogue with the maritime sector.Second, the Committee adopted a resolution on the status of Palestine and itsparticipation in ILO meetings, following the decision of the ILO Governing Body and in line with United Nations General Assembly Resolution ES-10/23.The Employers’ Group acknowledged the political sensitivity surrounding thisdiscussion and the profound human consequences of the ongoing crisis. At thesametime,our position in the Committee remained focused on theinstitutional nature of this resolution. We supported the adjustment thatentails a reaffirmation of the ILO’s duty to act consistently, transparently, andinaccordance with the decisions of the broader multilateral system.Third,and perhaps the most consequential,the Committee adoptedmeasures under Article 33 of the ILO Constitution in response to Myanmar’scontinued non-compliance with the recommendations of the Commission ofInquiry.This marks the third time in the Organisation’s history that Article 33 has beeninvoked—atestamenttothegravityofthesituation.The Employers’ Group reaffirmed our support for the ILO’s supervisorysystem.However, we also urged caution.We emphasised that the measuresadopted must be principled, proportionate, and focused on improving compliancewithout creating further harm to Myanmar’s workers orenterprises.We have particularly stressed that the application of Article 33 mustsafeguard the ILO’s credibility and moral authority, while avoiding anymeasures that could undermine livelihoods on the ground. It is essential toclarify that this provision should not be interpreted as a call for economicsanctions, which would jeopardise the sustainability of enterprises andcause profound harm to workers, their families, and already fragile localeconomies.It is important to recall that Article 33 is not a sanctions mechanism. It is aprovision for the Conference to call for appropriate measures to securecompliancewith the recommendations of a Commission of Inquiry—measuresthat should be rooted in the ILO’s unique tripartite andcooperative approach. Anysteps taken must be proportionate,evidence-based,and clearlybenchmarked. We must avoid broad, punitive approaches that may furtherendanger livelihoods and social cohesion. Instead, our aim should be tosupport conditions for peace, dialogue, and constructive engagement.Let me be very clear: the livelihood of the people of Myanmar must remainour foremost concern. We must not adopt short-term measures that worsenthe current situation.President,The decisions of the General Affairs Committee this year reflect a carefulbalancingof institutional responsibility,political sensitivity,and legalcoherence.I take this opportunity to thank the Chair of the Committee for leading a fairand inclusive process, and to acknowledge the contributions of the Workers’Group and Government representatives. As Employers, our constant objective is to ensure that the ILO remains acredible, technically sound institution—grounded in tripartism and responsiveto the challenges of our time.We support the adoption of the decisions of the General Affairs Committee bythis plenary.Thank you.
