COURTOFARBITRATIONFORSPORT(CAS) ARBITRATIONRULESFORTHEFIFACLUBWORLDCUP2025TM ARBITRATIONRULES FORTHEFIFACLUBWORLDCUP2025 Article1ApplicationofthePresentRulesandJurisdictionoftheCourtofArbitrationforSport(CAS) ThepurposeofthepresentRulesistoprovide,intheinterestoftheparticipatingclubsandofsport,fortheresolutionbyarbitrationofanydisputescoveredbyArticle50oftheFIFAStatutes,insofarastheyariseduring-andinconnectionwith-theFIFAClubWorldCup2025("FIFACWC"),i.e.between14Juneand13July2025,bothdatesincluded. Article2AdhocDivision FortheperiodoftheFIFACWC,theInternationalCouncilofArbitrationforSport(ICAS)shallestablishanadhocDivisionoftheCAS(hereinafterthe“adhocDivision”),thefunctionofwhichistoprovidefortheresolutionbyarbitrationofthedisputescoveredbyArticle1bymeansofPanelssetupinaccordancewiththepresentRules. TheadhocDivisionconsistsofarbitratorsappearingonaspeciallist,aPresidentandaCourtOffice. Article3SpecialListofArbitrators TheICAS,actingthroughitsBoard,shalldrawupthespeciallistofarbitratorsreferredtoinArticle2. ThisspeciallistconsistsonlyofarbitratorswhoappearontheCASfootballlistofarbitrators. ThespeciallistofarbitratorsshallbepublishedbeforetheopeningoftheFIFACWC.ItmaybesubsequentlymodifiedbytheICASBoardwherenecessary. Article4Presidency TheICASBoardshallelectthePresidentoftheadhocDivisionandhisorherDeputyfromamongthemembersoftheICAS.ThePresidentshallperformthefunctionsconferreduponhimorherbythepresentRulesandallotherfunctionsrelevanttotheproperoperationoftheadhocDivision. ThePresidentandDeputyPresidentoftheadhocDivisionmustbeindependentoftheparties. Article5CourtOffice TheCASCourtOfficeisestablishedinLausanne,Switzerland,andisplacedundertheauthorityoftheCASDirectorGeneral. Article6LanguageofArbitration ThearbitrationshallbeconductedinEnglish,FrenchorSpanishasdeterminedbythePresidentoftheadhocDivision. Article7SeatofArbitrationandLawGoverningtheArbitration TheseatoftheadhocDivisionandofeachPanelisinLausanne,Switzerland.However,theadhocDivisionandeachPanelmaycarryoutalltheactionswhichfallwithintheirmissionorineveryotherplacetheydeemappropriate. ThearbitrationisgovernedbyChapter12oftheSwissActonPrivateInternationalLaw. Article8RepresentationandAssistance Thepartiesmayberepresentedorassistedbypersonsoftheirchoiceinsofarascircumstancespermit,particularlywithregardtothetimelimitsetfortheaward.Thenames,addresses,emailaddressesandtelephonenumbersofthepersonsrepresentingthepartiesanddetailsofanyotherwrittenformsofelectronic communicationbywhichtheymaybereachedshallappearintheapplicationreferredtoinarticle10orbesubmittedatthestartofthehearing. Article9NotificationsandCommunications a)AllnotificationsandcommunicationsfromtheadhocDivision(Panel,PresidencyorCourtOffice)shallbegivenasfollows: -totheappellant:bydeliverytotheaddressappearingintherequestorattheelectronicmailaddressspecifiedintherequest. -totherespondent:bydeliveryorelectronicmailtohisorherofficeorplaceofresidenceduringtheFIFACWC. TheadhocDivisionmayalsogivenotificationsandcommunicationsbytelephoneandconfirmthemsubsequentlyinwriting,orbyelectronicmail.Intheabsenceofwrittenconfirmation,thecommunicationisneverthelessvalidiftheaddresseehadactualknowledgeofit. b)NotificationsandcommunicationsfromthepartiesshallbesentbyelectronicmailtotheCourtOffice. Article10Application AnyindividualandlegalentitywishingtobringbeforetheadhocDivisionoftheCASadisputewithinthemeaningofarticle1ofthepresentRulesshalldeliverorsendbyelectronicmailawrittenapplicationtotheCourtOffice. Theapplicationshallinclude: -acopyofthedecisionbeingchallenged,whereapplicable; -abriefstatementofthefactsandlegalargumentsonwhichtheapplicationisbased; -theappellant’srequestforrelief; -whereapplicable,anapplicationforastayoftheeffectsofthedecisionbeingchallengedorforanyotherpreliminaryreliefofanextremelyurgentnature; -anyappropriatecommentsonthebasisforCASjurisdiction; -theappellant’saddressandelectronicmailaddresswhichtheappellantcanbereachedforthepurposesoftheproceedingsand,whereapplicable,thesameinformationforthepersonrepresentingtheappellant. TheapplicationshallbewritteninEnglish,FrenchorSpanish. IftheClubsconcernedarenotpartiestotheproceedingsanddonotreceiveacopyoftheapplicationinthatcapacity,thisapplicationshallbecommunicatedtothemforinformationpurposes. Article11Timelimitforthefilingoftheapplication TheapplicationshallbedeliveredorsentbyemailtotheCourtOfficewithinthetimelimitsetbyArticle50oftheFIFAStatutesandprovidedthatallinternallegalremediesatFIFAhavebeenpreviouslyexhausted. Article12FormationofthePanel Uponreceiptoftheapplication,thePresidentoftheadhocDivisionappointsaSolearbitratororaPanelcomposedofthreearbitratorsappearingonthespeciallistwithinthemeaningofarticle2oftheRules(the“Panel”)andappointsthePresidentofsuchPanel. IfanapplicationisregisteredwhichisrelatedtoanarbitrationalreadypendingbeforetheadhocDivision,thePresidentoftheadhocDivisionmayassigntheseconddisputetothePanelappointedtodecidethefirstdispute.Inordertodecideuponsuchassignment,thePresidentoftheadhocDivisionshalltakeintoaccounta
